This policy explains what personal information we collect, why we collect it, who we share it with, and how you can access or correct it. It covers our website at mjeec.com.au and the information we hold about enrolled children and their families.
The law that applies to us
Many small businesses in Australia are exempt from the Privacy Act 1988. We are not. Child care services are specifically excluded from that exemption, so the Australian Privacy Principles apply to us in full, along with the Notifiable Data Breaches scheme.
We are also bound by the Education and Care Services National Law and National Regulations, which set separate rules about the records we must keep and how long we must keep them.
What we collect
If you are just visiting our website
You can read almost all of our website without telling us anything about yourself.
If you contact us — through our enquiry form, our waitlist form, our fee estimator, by email or by phone — we collect the details you give us. That is usually your name, your email address, your phone number, your child’s age, and when you are looking to start.
Our fee estimator does its calculation in your own browser. The income figure you type in is not sent to us, and we never see it. If you ask us to email you the estimate, we receive your name and contact details along with the room and number of days you selected.
If your child is enrolled with us
We collect what we need to care for your child safely and to meet our legal obligations. This includes your child’s name, date of birth and address; your details and those of anyone else authorised to collect them; emergency contacts; court orders or parenting plans if they apply; Customer Reference Numbers for Child Care Subsidy; immunisation records; and information about your child’s health, allergies, medical conditions, dietary needs and any additional needs.
Health information is sensitive information under the Privacy Act. We collect it only where we need it to care for your child, and we handle it with more care than ordinary contact details.
We also create records as we go: attendance, incident and injury records, medication records, developmental observations, learning stories and photographs.
Photographs and video of your child
This is the part parents ask about most, so we will be specific.
We ask for your permission separately for each different purpose. Agreeing to photographs for your child’s own learning journal does not mean we can put your child on Instagram. The permissions we ask for are:
- your child’s own learning documentation, which only you and our educators see
- displays in the room and group journals, which other families at the centre may see
- our social media, our website and our printed material, which anyone can see
You can say no to any of these and still enrol. You can change your mind at any time by telling Lauren, and we will stop using new images straight away and remove what we reasonably can. We will be honest with you about what we cannot retrieve — once something has been shared or downloaded by someone else, we cannot always get it back.
If we take a group photograph and one family has not given permission for that purpose, we take a separate photograph rather than cropping or blurring.
Photographs are taken on centre-owned devices only. Since 27 February 2026, NSW law prohibits our educators from having personal devices capable of taking photographs while they are working directly with children, and our own policy has always been that no educator posts a child from a personal account.
How we use your information
- To educate and care for your child, and to keep them safe
- To contact you, including in an emergency
- To administer your enrolment, your fees and your Child Care Subsidy
- To meet our obligations under the National Law and Regulations
- To answer your enquiry if you have contacted us
We do not sell your information. We do not share it with advertisers. We do not add you to a mailing list because you asked us a question.
Who we share it with
- Services Australia and the Department of Education — attendance and enrolment data, so that Child Care Subsidy can be paid
- NSW Department of Education — enrolment data for Start Strong fee relief
- The NSW Regulatory Authority — where we are required to notify a serious incident or complaint, or where records are requested during an assessment or investigation
- Kinderm8 — the software we use for enrolments, attendance, billing and our family app
- Emergency services and medical practitioners — where your child needs urgent care
- Police, child protection agencies or a court — where the law requires or permits it, including where we are required to report a concern about a child’s safety
Information sent overseas
Our enquiry and waitlist forms are provided through Storypark, which is based in Wellington, New Zealand. If you complete one of those forms, the information you enter is handled in New Zealand. Some of our other software providers may also store or back up data outside Australia. We remain accountable for your information wherever it is held.
Cookies, analytics and social media
We use Google Analytics to understand how people find and use our website — which pages are read, how long people stay, and roughly where visitors are located. This tells us about visits, not about identifiable individuals, and we do not use it to build a profile of you.
Our website displays our public Instagram feed. If you interact with it, Instagram’s own privacy policy applies to that interaction, not ours.
Our website uses security software that records IP addresses in order to block malicious traffic.
You can block or delete cookies in your browser settings. Our website will still work.
Keeping your information safe
Enrolment and child records are held in access-controlled systems. Paper records are kept in locked storage. Only staff who need particular information to do their job can see it. Educators are trained on confidentiality and sign a code of conduct.
If a data breach occurs that is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner, as the Notifiable Data Breaches scheme requires.
How long we keep it
The National Regulations set these periods, and we follow them:
- Incident, injury, trauma and illness records — until the child turns 25
- Developmental assessments and evaluations — 3 years after your child last attended
- Medication records — 3 years after your child last attended
- Enquiry and waitlist information — we keep this only while it is useful to you. If you ask us to delete it, we will
Where a child has died, records are kept for 7 years after the death.
Seeing and correcting your information
You can ask to see the personal information we hold about you or your child, and you can ask us to correct anything that is wrong. You can also ask for a copy of your child’s developmental records at any time — the Regulations give you that right.
Email info@mjeec.com.au or speak to Lauren. We will respond within 30 days. There is no charge. In rare cases we may not be able to give you everything — for example, where it would reveal information about another person, or where a court order restricts it — and if that happens we will tell you why in writing.
If you are unhappy with how we have handled your information
Tell us first. Speak to Lauren Ziegler, our Director and Nominated Supervisor, on (02) 9315 5588 or email info@mjeec.com.au. We will acknowledge your complaint within 5 business days and give you a written response within 30 days.
If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992. You do not need our permission to do that.
Changes to this policy
We review this policy each year and whenever our systems change. Where a change significantly affects enrolled families, we will give you at least 14 days’ notice before it takes effect, as the National Regulations require. The date at the top tells you when it was last updated.
